Agreement

By using this website or placing an order, you agree to these terms. If you do not agree, please do not use the site.

The site is operated by Don Creatives, 30 N Gould St Ste R, Sheridan, WY 82801, United States. "We", "us", "our" and "Noovaria" refer to Don Creatives.

Who can order

You must be at least 18 years old to buy from this store. By placing an order you confirm that you are 18 or over and legally able to enter into a contract.

Your account details

You are responsible for giving us accurate contact and delivery details, and for keeping your account credentials to yourself. We are not able to replace an order that failed because the details given to us were wrong.

Our products

We sell personal massagers for home use. They are intended for relaxation and the temporary relief of minor muscle aches.

They are not medical devices. They are not intended to diagnose, treat, cure or prevent any disease or condition, and nothing on this website is medical advice. Please read our Safety and Use page and the instructions supplied with your product before using it, and do not use a product if a listed caution applies to you.

Descriptions and prices

We do our best to describe products accurately, but we do not warrant that descriptions, images, specifications or other content are error free. Colours can display differently from screen to screen.

Prices are shown in US dollars and can change without notice. We reserve the right to correct pricing errors and to cancel any order placed at an incorrectly listed price, refunding you in full.

Orders

Your order is an offer to buy. We may refuse or cancel any order at our discretion, including where we suspect fraud, where a product is unavailable, or where a pricing or description error has occurred. If we cancel an order you have already paid for, we refund it in full.

Payment and chargebacks

Payment is taken at checkout through our payment provider. If you have a problem with an order, please contact us first at support@noovaria.com. We answer within one business day and we would far rather solve it directly than through a chargeback. Filing a chargeback without contacting us does not speed anything up, and we reserve the right to contest a chargeback where the order was delivered as described.

Our refund policy forms part of these terms.

Prohibited use

You may not use this site to break the law, to interfere with its operation or security, to scrape or copy it for a competing service, or to submit anything false or misleading.

Intellectual property

All content on this site, including text, images, product photography, logos and design, is owned by Don Creatives or licensed to us, and may not be copied, reproduced or used commercially without our written permission.

Limitation of liability

To the fullest extent permitted by law, Don Creatives is not liable for indirect, incidental, special or consequential damages arising from your use of our products or this website. Our total liability for any claim is limited to the amount you paid for the product concerned.

Nothing in these terms limits liability that cannot be limited by law, including liability for death or personal injury caused by negligence, or for fraud.

Events outside our control

We are not liable for delays or failures caused by events outside our reasonable control, including carrier disruption, severe weather, industrial action, and failures of infrastructure or supply.

Governing law and disputes

These terms are governed by the laws of the State of Wyoming, United States. Any dispute will be handled in the state or federal courts located in Sheridan County, Wyoming, and you and we both consent to that jurisdiction. Nothing here prevents you from bringing a claim in a small claims court where one is available to you.
